ETX Hydroseeding, LLC wishes to clarify certain limitations in our scope of responsibility regarding our services.

• Environmental and Site-Related Factors: We are not liable for erosion issues caused by heavy rains or excessive irrigation, nor for failures in sloped areas and dirt work. Additionally, we do not guarantee grass performance or germination in shady areas with acidic soils, especially those near pine or cedar trees.
• Pre-Existing Conditions and Site Preparation: Areas with existing vegetation, soils high in clay or iron ore, and poorly prepared seed beds fall outside our responsibility. Bermuda grass, specifically, is not recommended for clay or iron ore soils.
• Irrigation System Considerations: We are not accountable for germination of weeds due to pre-existing conditions. Additionally, we hold no responsibility for damages to irrigation systems. The installation and repair of these systems are the responsibility of property owners or contractors.

• Guidance for Optimal Performance: While we offer recommendations for optimal growth as noted in our site plan, we are not responsible for the failure to adhere to these recommendations.
• Client's Role in Site Preparation and Aftercare: The client must ensure proper site preparation, including pH correction. We are not responsible for the dominance of rye or other competing grasses if the site is not adequately prepared.

• Service Estimate Conditions: Please be aware that our estimates are subject to change based on project size alterations or additional soil disturbance during construction or demolition.
• Payment Terms: Full payment is required at the time of service, which can be made via cash or check.

• Liability for Ancillary Services: We do not assume responsibility for companies referred for ancillary services.
• Withdrawal of Services: We reserve the right to withdraw our estimate or refuse services before commencing hydro mulching.
• Overspray and Damages: While we make reasonable attempts to prevent overspray, we are not liable for any resulting damages. It is the property owner's responsibility to make necessary accommodations before our arrival.
